Terms and Conditions

 

1. Scope
These Terms and Conditions apply to the use of the mobile application “gebioMized App” by business customers (B2B) who have entered into a valid license agreement with SnM gebioMized GmbH, Wilhelm-Schickard-Str. 12, 48149 Münster, Germany (hereinafter referred to as “Provider”). End customers do not have their own access to the app.

2. Subject Matter
The app enables authorized business customers to perform mobile saddle pressure measurements on bicycles and to store and manage associated data. Use of the app is permitted only within the scope of a valid B2B license agreement.

3. User Accounts
Access to the app is provided via individual business accounts activated by the Provider. End customers can be created within the app by B2B users but cannot log in independently.

4. Data Storage and Privacy
By using the app, the user expressly agrees that personal data (in particular name, email address, and measurement data) will be stored on the Provider’s servers.
Storage takes place on Microsoft Azure servers within the European Union. Data is accessible only to the Provider and is processed in accordance with the EU General Data Protection Regulation (GDPR). A separate Privacy Policy explains data processing in detail.

5. Liability
The Provider is liable only for intent and gross negligence. In cases of simple negligence, liability exists only for the violation of essential contractual obligations and is limited to foreseeable, contract-typical damages. The Provider is not liable for data loss, incorrect measurements, or technical failures unless caused by intent or gross negligence.

6. Intellectual Property
All rights to the app, including software, design, content, and trademarks, remain with the Provider. The user receives only a non-transferable, non-exclusive right of use within the scope of the license agreement.

7. Termination and Suspension
Usage rights automatically end upon expiration or termination of the underlying license agreement. The Provider reserves the right to suspend access if the user violates these Terms.

8. Jurisdiction and Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction is Münster, Germany. For customers outside the EU, applicable U.S. legal standards may apply as required.
Access to personal data from third countries (including the U.S.) is allowed only under compliance with the EU–U.S. Data Privacy Framework or based on Standard Contractual Clauses (SCC).

9. Final Provisions
If any provision of these Terms is invalid or unenforceable, the validity of the remaining provisions shall not be affected. Amendments or supplements must be made in writing.
